How often should I update USCIS of changes in my chosen EB-5 Project?

I was informed that my project received its I924A exemplar approval last week. Do I need to inform USCIS? I have already filed my I526 petition back in June 2016. Am I responsible for providing interim updates?

Your EB-5 immigration attorney can advise you. An exemplar application being approved means that the EB-5 project documentation is approved. Every I-526 petition is comprised of the EB-5 project documentation. Therefore, your EB-5 Immigration attorney could form the USCIS of your pending I-526 petition. As a result, the USCIS should only adjudicate your lawful source of personal funds documentation, as the EB-5 project documentation in your I-526 petition has already been approved.

Updating USCIS is not required, but if USCIS issues a Request for Evidence (RFE), then you can update them with the exemplar approval, in addition to addressing the other issues in the RFE. You could also email the exemplar approval to the USCIS Investor Program Office with your receipt number (WAC#) as a reference, but there is no guarantee that the information will be placed in the file or be transmitted to the officer adjudicating your I-526 petition.

No, if the project received its I-927 Exemplar Approval from the USCIS, you would not need to inform the USCIS as they would have access to that information. You do not need to provide them an update; normally, that would be done by the attorney representing you and the project developer.

Unless there is a significant change to the project, which would require a filing of an amended Petition, updates are not required.

Thank you for your EB-5 investment related question. I would certainly advise USCIS of any updates to the underlying project approval, such as the exemplar approval. It is important that you have experienced EB-5 immigration representation throughout the entire process.

It appears you are working with a regional center (RC). As a result, the RC should be the one undertaking all activities related to your petition.

USCIS will know about the exemplar approval and the I-526. The Regional Center likes to get a copy of the I-526 receipt for their records.

It is very helpful to notify USCIS that there is an approved exemplar associated with your project.
