If we file an I-526 petition and an expedition request, and if the request is approved, how long do I need to wait for Form I-526 to be processed?

Expedites are unpredictable. Everyone wants an expedite. We have seen expedite approval in a few months, four months or six months. But predicting the adjudication time for I-526 is extremely difficult, especially since they tend to adjudicate by project in batches in many instances, but not always. I advise clients that it is going to take about two to 2.5 years, but times are constantly changing. Many take less than two years.

The time frame varies and also depends on how well individual petitions are put together. A reasonable presumption is between four to eight weeks. However, be aware that expedited requests are rarely granted.

It is very hard to tell how long it will take for expedited approval of an I-526 petition, but assuming the expedite request is approved, which often does not happen, it could be approved within as little time as three months.

Please note that there is no premium processing for I-526 to formally request speeding up the process. Requests for expediting require a high burden of extensive evidence demonstrating some need to speed up the review process, and they are granted solely at the discretion of USCIS and are rarely approved, particularly under this administration.

Expedite requests are rarely granted. When they are, it would depend on the reason for the expedite request. I have see approvals in 60 days but, again, these are extraordinarily rare. Currently posted I-526 processing time is 22 to 25 months, so a need shorter than that would require an expedite request. That said, without such a request, it is possible to get an approval in less time. Adjudication times are all over the map.

These are rarely approved unless there are extreme circumstances, although some regional centers have approved I-526 templates that makes their processing quicker.
