How is concurrent filing working for H-1B visas?

I would like to pursue the EB-5 visa as the H-1B landscape in the U.S. becomes more complicated. I am starting my third year working under this visa; however, I do not expect my employer to renew my visa for another three years. I would like to know if the concurrent filing option is still available.

Possibly depending on the category of EB-5 and your country of birth. Be sure to maintain your status though until the I-485 is received by USCIS and even thereafter if possible.

Yes, concurrent Adjustment of Status (AOS) is an option for EB-5. Pending AOS will give you a work authorization and travel document while you are waiting for your green card to be approved.

Concurrent filings have become a hot topic of discussion with some indications that ICE has detained certain overstays during certain USCIS interviews but this is not a policy being enforced across the border. It is
best to discuss during a consultation.

It is nice suggestion but get an informed legal opinion before taking a decision.
