How does the EB-5 visa program differ by U.S. state?

I am looking to get my U.S. green card through the EB-5 visa program. I have no preference for where I move, just as long as it's in the United States. I wanted to find out if the states each have different requirements for the EB-5 program? Once I come here, can I move around between states, or do I have to buy a house and live in one area while my EB-5 application is pending?

The EB-5 program is a federal program and states do not have separate EB-5 programs. You are free to live, work, study, or retire in any state of the United States when applying for a green card through the EB-5 program.

An EB-5 investment can be made in any state and the investor can reside in a different state. The investor can still reside in their home country until they obtain their conditional permanent residency. In addition, the investor can be residing in the United States under a legal nonimmigrant status such as a F-1 student status, or working visa status.

EB-5 is a federal immigration program. There are hundreds of EB-5 programs all over the country and in every state. The beauty of the program is that once you have conditional residency (after the I-526 and immigrant visa processing are approved), you may enter the United States and live and work anywhere without any restrictions on your movement. You do not need to be near the business/project in which you have invested unless you wish to do so.

Regulations governing EB-5 immigrant investor petition processing are federally mandated and therefore do not vary from state to state. Where you reside is also not a factor as long as the commercial enterprise is located in the Targeted Employment Area (if applicable).

You can live anywhere in the United States, not in the state in which the EB-5 project is located. The only thing a state is involved in is how they calculate a Targeted Employment Area, which determines if the project can accept $500,000 investments or $1 million investments. The project principals will handle that for you.
