How do EB-5 investors protect themselves against fraud?

I am the victim of an EB-5 investment fraud currently under FBI investigation. My I-526 petition case was approved in 2013 when the investigation was initiated. I”m currently under I-485 status adjustment and have not received a final decision from USCIS yet. I would like to know what rights and options I have in order to protect my legal status, my investment money and my green card application opportunity.

The proposed regulations and some of the proposed legislative changes give some protection against fraud, but it may be advisable to consult with experts in the field since the pending adjustment puts you in a difficult position. If denied, you will likely be put into a removal hearing.

It is advisable that you should review the grievance procedure(s) and employ an attorney to pursue all available remedies. Also, do not omit participation in any group action, assuming one is underway as long as your interest is being adequately addressed.
