How do you transfer EB-5 capital out of India?

With the recent regulation imposed by the Reserve Bank in India, how does one go about applying for an EB 5. I have the money, that is USD 500,000.00 but how do I send it to the USA, when the government has imposed a maximum amount of USD 75,000.00.

USCIS accepts certain methods of transferring money. An experienced EB-5 attorney will best address your concerns.

It would be best for you to speak directly with an experienced EB-5 immigration attorney, such as myself, who will advise you on U.S. immigration law requirements for proving that your funds were obtained from a lawful source and the best way to document the transfer of those funds from your home country to the United States. There may be a few options available to you.

Other countries have similar limits on the amount and kind of transfer of funds into the U.S. Our law firm has experience with these types of investments, and could represent you and develop an approvable U.S. Immigration plan, authentication of source of funds, and I-526 petition.

An experienced EB-5 Attorney will be able to advise you of a lawful strategy accepted by the USCIS in their adjudication of the I-526 petition which incorporates the authentication and transfer of your personal funds from accounts in India.

India is certainly the new frontier for EB-5 investments. It is true that the recent capital outflow restrictions might appear to dampen investment enthusiasm, however, as P. Chidambaram noted, these measures are largely temporary and will be revisited upon the rupee''s stability. The RBI''s moves are not surprising and with the rupee as recently as today dipping to 64.5 (and largely market driven pessimistic projections note that it may dip as low as 68-70 in the coming weeks), a certain level of volatility is expected. In the meantime, there are other methods by which an investor, such as yourself, can navigate these controls. If you would like, I would be happy to offer you a brief complimentary consultation to further discuss some strategies.
