How can I withdraw my investment with a conditional green card?

I am an EB-5 investor with a conditional green card. I do not want to proceed with EB-5 anymore and need to withdraw my money from the investment due to personal reasons. I am having a hard time getting answers from my attorney or the regional center. What options do I have?

    It is between you and the regional center. You should have a right to your money back.

    The terms and conditions of your investment with the EB-5 regional center project are listed in one or more of the agreements you signed. You should have an independent business law attorney review these contracts and advise you of your rights and obligations vis-a-vis the regional center.

    It is important to understand that your investment is independent from your immigration application. It is controlled by the terms of your contract with the regional center.

    You have to look at the terms of the subscription agreement to determine when and under what circumstances you can withdraw your funds.

    It really depends on the documents you have with the regional center. An attorney can review your papers and give you an answer. Also, they can contact the regional center on your behalf. We have been successful a few times in getting our clients? money refunded.

    Your options will be detailed in the PPM and other investment-related documents you signed. Your attorney should help you with this process, but note that you may not be able to withdraw the funds until the loan has been paid back. Finding a replacement investor now is unlikely.

    As a conditional permanent resident, withdrawal just because you don''t want to continue may be possible only if your subscription agreement allows such withdrawal. Also, at this point, the regional center would have invested your money. As a result, you may have to wait until other investors are being paid upon the dissolution of the partnership before your money is returned just like all other investors. However, another option that you should consider is a negotiated withdrawal with the regional center. Advisably, consult an attorney particularly in reviewing your subscription agreement and other related documents constituting your agreement.

    EB-5 has a sustained investment requirement that ends when you apply to remove conditions. If you take the money out now, you will not be able to submit a successful I-829 petition.
