I would like to withdraw my pending I-526 petition. What steps should I take? How long it would take for me to obtain that letter of withdrawal from USCIS?

EB-5 Immigration attorneysYou can try the E-Tools section on USCIS''s Web site, or send a letter to the Immigrant Investor Program Office requesting it. I have seen responses take anywhere from a few weeks to a couple of months.

EB-5 Immigration attorneysYou need to send a certified mail return receipt document because USCIS will not acknowledge withdrawals.

EB-5 Immigration attorneysA withdrawal is as simple as sending a letter to USCIS IPO. I usually send via email and hard copy/courier. Do note that a withdrawal is not reversible. IPO has been taking a very long time to process. In my experience, two months and up. But you can push them on this.

EB-5 Immigration attorneysDid you invest the money? Is this your own project or someone else''s project? You want to make sure you can get your money back. If you invested in someone else''s project, it is up to them and the documents you signed whether you can get your money back. You can write a letter to the Immigration Service immigration investor office in Washington, DC and inform them you want to withdraw your case. Give them your file number - that can be found on your filing fee receipt or on any correspondence with them.

EB-5 Immigration attorneysNormally you just send a letter to USCIS with a copy of the receipt. You need to check with the project though as this does not necessarily mean they will refund your funds.
