I am an F-1 visa student in the U.S. and recently had my I-526 approved. I plan to submit my DS-260 at the U.S. embassy in Korea this September and hope to schedule my interview in March. During the time my DS-260 is being processed, how can I travel abroad and return to the U.S. on my F-1 visa?

EB-5 Immigration attorneysIf you have a current valid unexpired visa in your passport you should be able to travel however since you have a pending green card you maybe be subject to secondary inspection due to immigrant intent issues. If possible, avoid travel.

EB-5 Immigration attorneysIf you are asked about your EB-5 upon reentry, you should show your immigrant visa fee payment receipt and DS-260 confirmation and explain that you plan to apply for your immigrant visa abroad. Make sure that you have a valid F visa stamp and endorsed Form I-20.
