How can I include my daughter in my EB-5 petition?

My daughter was conceived and born after we filed our EB-5 petition. Our I-526 was just approved. We are doing consular processing. How can we add her to the case?

    Just add her to the DS-260 application and provide her birth certificate including all relevant information. Advisably, consult either your EB-5 attorney or any attorney of similar nature for prompt attention before your DS-260 is approved.

    When you receive a case number from the National Visa Center, you can email them a copy of your daughter''s birth certificate and passport biographic page. You need to ask them to add her to the case and issue a separate immigrant visa fee bill for her. You will then pay the IV fee bills for yourself and all your dependents and follow the NVC''s instructions about how to submit your civil documents as you wait for your immigrant visa interview.

    You can add her during the Immigrant Visa processing (if you are abroad and doing Consular processing) or Adjustment of Status (if you are in the U.S.).

    You should request that NVC add a dependent to your case and issue a fee bill for her. Do not proceed with your case until she has been added. You will need to provide her BC as evidence of the parental relationship.

    The NVC invoice will provide instructions to add family members, which is good because they often leave out all the family members anyway. You will need a copy of her birth certificate to send them.

    Once you get the fee bill from the National Visa Center then upload your daughter''s birth certificate and ask for a corrected fee bill adding her.

    Send a copy of her birth certificate to the NVC and ask for a fee bill. If you plan to file an adjustment, no problem just complete another I-485, etc. for her.
