How can I gift EB-5 investment funds to more than one person at the same time?

Can I gift the EB-5 investment funds to more than one person (siblings and spouse’s siblings) at the same time so they don’t have to wait 12 – 13 years for family-based immigration after I become a U.S. citizen?

Very possible if the funds being gifted were lawfully earned by you and you can demonstrate that. The attorney can draw up a simple gift letter (or loan but the loan can’t be secured by the project).

You can gift funds to multiple EB-5 investors. You will be required to provide evidence of lawful source of the funds gifted, that is how you originally came up with the funds: earnings, inheritance, sale of properties, etc.

You can gift as many people as you want provided you can provide your lawful source of funds for the gifts.

Yes, of course you may be able to gift funds to multiple family members. You may want to also seek the advice of a competent tax counsel or advisor who can guide you through any tax obligations. But there is no limit to how many family members you can gift to – assuming you can properly document the origin and source of the funds you are gifting.

Gifts are permitted as the source of funds for any number of EB-5 petitions. However, the EB-5 petitioners would need to be prepared to show lawful source of all funds. This may mean that you - the original donor - may be required to provide documentation showing how you lawfully acquired those funds. The gifted funds must also be fully in the possession and control of the EB-5 investor when they are invested into the EB-5 enterprise. Consult with an experienced EB-5 attorney to navigate the process with confidence.
