How can I get my EB-5 investment back if my application was denied?

Hello. My I-526 was denied due to not completing documentation (which was asked for four years after the application date), and I could not provide it. I have paid the investment in full. What can be done so I can get my investment back?

You need to review the project documents to see what their rules are on this. Start by reviewing these and speaking with the project. Are you able to start over and re-file with the proper documentation?

You need to read the investment documents, such as PPM, the Operating Agreement, or the Subscription Agreement to see if there are any specific terms about refund after I-526 denial.

Read your investment contract and follow the steps outlined in there regarding a “denied I-526”.
