How can I check if the I-526 of an EB-5 project is approved?

The five-year period of the EB-5 project I have invested in will be reached in May 2021 and my investment will need to be redeployed to another project. I am wondering if it is possible to check the status of the I-526 for the new EB-5 project.

The new project doesn''t need to meet the same requirements as the original new commercial enterprise, and I haven''t seen that there is a pre-approval process for the redeployment project. So, USCIS may determine that the redeployment is acceptable on a case by case basis. The project principals or regional center should tell you if their original EB-5 projects have been pre-approved or have received previous I-526 approvals.

You can ask to see if there are any approvals on the new project or if the project has been an exemplar approval.

You can check on the USCIS website with the Case Number on the I-526 receipt.

I-526 approval status can be viewed on the USCIS website. Redeployment of funds has nothing to do with I-526 approval. You should have someone review your project documents and make sure that the project sponsor is in compliance with the rules regarding the redeployment.

Usually, the deployment is not to another EB-5 project. Check with your EB-5 issuer company.

I wonder if you are confusing I-526 with I-924 or I-829. A project does not have I-526s or I-829s, investors do. Either way, the project should provide all this information to you.

EB-5 projects do not file I-526 petitions unless you are referring to an exemplar, which means the regional center has filed an amendment to its USCIS designation (Form I-924) and included an I-526 as an exemplar. Online case status is not available for this type of filing. If you are unsure about the status of your particular case or the status of your regional center seeking USCIS approval of the redeployment plan, you should contact your immigration attorney or the representative of the EB-5 regional center.
