How can I apply for the EB-5 visa without the 60-day grace period?

The news is saying that the US government is trying to remove the 60-day grace period. I just received my H-1B visa and plan to transition to an EB-5 visa after completing my 3-year contract. My plan was to prepare my application for the next three years, while waiting for the program to be renewed. Is that grace period necessary for applying for the EB-5 visa?

Hopefully if needed you can extend your H-1B instead up to 6 year limit.
