I obtained my green card several years ago through EB-5. I am currently outside of the country. I plan to apply for a re-entry permit by sending the form I-131 to USCIS by mail. Can I send it from abroad and go back to the U.S. after the mail service delivers the form to USCIS? Will I need a receipt at the border checkpoint?

Immigration attorneysYou must be physically in the U.S. to apply for re-entry permit and also be present in the U.S. to complete your fingerprints appointment. A re-entry permit can be requested to be mailed to a U.S. embassy or U.S. consulate for you to pick up when it is approved, but you cannot apply for it outside the U.S. Otherwise, consider a returning resident visa if your circumstances warrant it and hire an immigration attorney to help you with preparation of the case.

If accepted, at the description of the USCIS office, you would have to submit a letter of explanation as to why you did not file while you were in the U.S.
