How can I apply for EB-5 as an F-1 student?

I am an Indian student with an F-1 visa. I will graduate in May 2021. To be able to secure a job, I want to apply for an EB-5 visa, and my father will gift me funds for the investment. How much time will it take to get it approved? What is the process?

Presently the process is taking about 2-3 years to get an approval but there is also another waiting line and there are estimates that this will take a few years. No-one is clear as the State department previously provided a longer than expected estimate.

It depends on which regional center you use. Most are several years. There is one with expedited processing of 3-7 months approximately and then you adjust status after the I-526 approval.

If you are graduating next year, it is advisable that you should start as soon as possible. I will urge you to contact an EB-5 attorney for immediate and adequate planning.

You can apply for an EB-5 but that will not necessarily keep you in the U.S. past your graduation.

Yes, you can file EB-5 now while you are on F-1.

With the virus, we see the results changing daily. I recommend you have a consultation with a qualified attorney that has staff in India to help advise you and your father.
