How can I apply for an EB-1 if the Gold Card will use this option?

My plan was to apply for the Einstein visa once I finished my PhD in the UK. The issue I see now is that the Gold Card program will be using these pathways for wealthy investors. Will my EB-1 application still be reviewed if I apply in the traditional way, not through the gold card?

Having a Ph.D. does not in itself qualify you for an EB-1A. You need to meet several criteria and I do not think the Gold Card (if it ever gets off the ground) will impact your eligibility.

No one knows what percent of EB-1 will be allocated to ‘gold cards” or even if this program will be found to be legal (litigation ongoing for this. If you will qualify for EB-1, then definitely apply.

Yes, according to the current official record, you can still file a normal, non-Gold-Card EB-1 petition, and it should still be accepted and adjudicated through the ordinary channel. USCIS still maintains the regular Form I-140 route for employment-based immigrant petitions, and the Gold Card uses a separate Form I-140G.
