I have an EB-5 green card. I applied for an I-131 re-entry permit and received the receipt and another DHS-USCIS notice on 20 Nov 2025 stating that my previously collected fingerprints and biometrics will be reused (collected 4 years ago). My USCIS status shows as “fingerprints taken.” However, given the change to the fingerprinting rule announced on 12 Dec 2025, does it apply retrospectively to my case as well, or only to new applications?

EB-5 Immigration attorneysIf the notice indicates that your biometrics will be reused, it is my belief that they are permanently captured and it is not required for you to attend to another biometric appointment.
