I am an F-1 student (MSc) planning to send my family green card application soon. I am aware that the processing time is up to one year. As a result, I am planning to apply for OPT (EAD) when I graduate in June and use OPT until my family green card arrives. My question is, would there be a conflict of interest between both applications? When sending the green card application, do I need to send form I-765 as well?

Find an EB-5 Visa Lawyer: Immigration AttorneyIt should be fine - are you applying to adjust status or consular process?

Find an EB-5 Visa Lawyer: Immigration AttorneyYou can submit more than one I-765. The processing times for EADs are all over the place; got one approval today where processing time was one day. Yes, one day. But still have many pending where processing time is pushing 4 months. The point is, do not rely on the government to do anything timely and file as many I-765s as you can.

Find an EB-5 Visa Lawyer: Immigration AttorneyYou simply apply for OPT as you would without the family based petition. OPT is not a change of status from F-1 to a different nonimmigrant visa.
