How does redeployment of EB-5 funds work?

I filed my I829 back in 2020 and am waiting for it to be processed. My project is complete and running and we have an option to receive the principal amount or deploy funds. How does redeployment work? Will it have an affect on my i829 application since the project it is redeployed in is going to be different from the original project? Or do the funds need to the same project and everything remains the same on file and redeployment is only to fulfill the ”at risk” requirement?

Legally, one only has to ensure the funds remain invested at the time you file the I-829. If you have filed the I-829, and the project has created the necessary jobs, then it should be safe to receive the principal funds back.

Redeployment is typically only to fulfill the at risk/sustainment requirement. Your attorney and the RC should be able to explain why such redeployment is acceptable without jeopardizing your permanent residency (because presumably they would not sign off if it was not ok).
