If the EB-5 program is not reauthorized, there will be concerns related to pending applications. Our understanding is that those that are pending would be grandfathered.

I would expect if not re-authorized, anyone who has already invested and filed will have their case adjudicated as per the rules in effect at the time of filing.

Those cases would likely be denied. However, the likelihood of this happening are slim as long-term reauthorization is in everyone''s best interest (that and the House just introduced legislation to do exactly that).
