In November 2019, USCIS confirmed it received my Form I-526. It”s through a Regional Center. it”s been more than 1 and a half years waiting outside the US. What is my application status now after the lapsed authorization for the EB-5 Regional Center Program? What should I do?

Find an EB-5 Visa Lawyer: Immigration AttorneyNot much you can do except wait for processing times to catch up and re-authorization by Congress.

Find an EB-5 Visa Lawyer: Immigration AttorneyIt''s pending. Nothing you can do about it now; the program must be reauthorized before USCIS will take action on it.

Find an EB-5 Visa Lawyer: Immigration AttorneyMost applications take at least 2 years to adjudicate. Presently, we are waiting for reauthorization, so this will likely be another 1-2 months since I do not expect to see reauthorization until October 1. We have had 30 reauthorizations since 1993, so we simply have to wait until we get the next one.

Find an EB-5 Visa Lawyer: Immigration AttorneyIt is still pending. USCIS will continue its adjudication after the Regional Center program is re-authorized. I-526 is now taking years to adjudicate according to published USCIS processing time. Litigation is probably the only effective way to get a result sooner.
