How long is the RFE processing times for EB-5?

How long does USCIS take to process I-526 RFE after providing the evidence? Anything I can do to speed up the process?

    USCIS does not really provide timelines. Sometimes their RFE says you can expect an answer in 60 days, but that also may very well not happen. If a case is pending too long, a writ of mandamus filed in federal court can compel USCIS to make a decision.

    The typical response time to a request for evidence is 60 days. Although, with the EB-5 program, the number is truly a variable.

    There is no consistency. We have seen 1-2 months, and we have seen them sit for months or years.

    The “standard” processing of any RFE is 60 days. If the I-526 is affiliated with a Regional Center, USCIS will not take any action at this time.

    Unfortunately, the only thing consistent with RFE response timelines is that there is no consistency. Some are approved within a week. Some 3 to 6 months. Some much much longer than that. Not much you can do other than file Mandamus.

    The processing can take between a few months and a couple of years depending on the complexity of the case.
