My agent said that the regional center will provide all the documents needed for I-829, the only thing I need to do is just to file the I-829 form and provide the copy of my green card, then the regional center will prepare all the required evidence and documents, is that true? Or what is the process?
An immigration attorney will review all requirements with you and review what the project provides.
It is a bit more complicated than that and there can be lots of issues after filing, such as continued evidence of your permanent residency status during the 4+ years the I-829 will pend. But certainly, the documents from the Regional Center are an important piece of the filing.
That is largely true. For I-829, the bulk of work is done by the project. However, if you have complications (such as criminal issues) your attorney may request more documents/information from you.
If your EB-5 case is in a regional center project, then the regional center should provide your attorney with a filing template that will be consistent with the other EB-5 investors’ I-829 filings. The I-829 must demonstrate that you sustained your investment in the project and that the new commercial enterprise created the required number of direct/indirect jobs. You must sign the I-829 and provide some personal documentation, but the bulk of the I-829 documentation will be provided by the regional center.
It is correct; the regional center must provide almost all the documents necessary to file the I-829. However, you need to coordinate with your lawyer to make sure the documentation submitted meets the USCIS eligibility criteria.
All I-829 documents have to be filed at the same time but yes, the majority of the documents will come from the regional center. Your attorney will coordinate with the regional center to obtain info for forms, which you should review before signing.
