How can I withdraw my EB-5 investment and get money back?

My I-526 has been approved but I do not want to proceed to the next step in EB-5. I”ve already become a permanent resident from another EB program. How can I get my EB-5 investment back?

If you are with a regional center investment, check your offering documents (PPM, subscription agreement, etc.) Those typically have the early exit procedures. Those are not necessarily governed by EB-5 regulations.

You need to look at the terms of your subscription agreement. Hopefully, you invested with a loan model and hopefully the loan has or is about to mature. Other than that you can always ask but absent misrepresentation or the fact you wish to abandon is not in itself a basis to demand a refund.

That is between you and the entity with which you invested. You need to read all the project documents about the terms for a withdrawal or retain counsel to do this on your behalf in the state in which the project is located.

Contact the project. Besides the immigration withdrawal, the more immediate issue is whether the project is able/willing to refund your money at this time. For most projects, once your I-526 is approved, you may be locked into the term of the investment. Good luck.

You should have an attorney well-versed in securities law review your offering documents to ascertain what the procedures are to withdraw your money. Your partnership or operating agreement should also have relevant information. Follow the redemption instructions to the letter.
