How can I apply for an expediate process at NVC for my EB-5 application?

My petition got approved 30 weeks back and I am waiting for NVC to start to process my petition. My father has a very critical medical situation, which requires him to get 4 to 5 hours treatment 3 days a week. He is a U.S. permanent resident and me being with him will be a huge advantage for him coping with his current situation physically. Does this qualify me to request for expediate NVC and visa interview process?

If your priority date is current, send an expedite request to NVC and they will check with the consulate.

We just resolved a situation like this. We filed Mandamus and had the case successfully transferred within 55 days.

It is highly unlikely that they would approve an expedite request in any EB-5 case; at least, I have never heard of them doing so. You might be able to get the Office of Humanitarian Parole in D.C. to give you a parole (visa to enter the U.S.) due to illness of dad. Have you tried to get a B-2 tourist visa?

If you can document the urgent humanitarian basis, it should be possible to apply to expedite.

Unfortunately, there is no expedited processing for EB-5. In fact, with regards to your situation, the USCIS is not likely to grant the request on the basis of your father''s health. If you should need to be in the U.S. , consider seeking entry through a visitor visa which typically lasts for as much as six months.
