How can I have the EB-5 regional center I invested in return my money due to the DHS withdrawal of appeal that ified the price increase?

I invested $900,000 in an EB-5 project in June 2021. In January 2022, the Department of Homeland Security”s withdrawal of appeal ified the $900,000 increase in November 2019. So why does the regional center not return my $400,000? Is it not my right? What kind of action can I take to make this happen?

This is an interesting question. The likely reason is that your PPM provides that each unit of the interests you purchased were sold in $900k increments. Now, if your operating agreement provides for fractional interests, there may be some recourse. But it sounds as if all of the funds have been deployed. An attorney will need to look at your deal documents and the timeline events you can provide as to relevant facts to advise you more properly.

Please read the investment documents (PPM, Subscription Agreement, LPA/OA) you signed as part of the subscription process. These docs will address the terms and you should have discussed them with your attorney.

Really that is between you and them. You should get a contact lawyer or investment lawyer.
