How can we best perform due diligence while looking at potential EB-5 regional centers?

We are looking at using EB-5 for a rural development we have in Colorado. As we look at potential regional centers, is there a common source we can use to evaluate if a regional center has had any legal issues or concerns in the past? What are your suggestions for the most effective due diligence?

First, it is not only about the regional center - there are good regional centers that have problem projects. There are two types of due diligence. Immigration due diligence - for which you need an immigration lawyer with EB-5 experience; and financial due diligence, which requires a financial expert with expertise in the EB-5 arena. Many of the same due diligence concepts that apply to any investment apply to EB-5.

There are companies authorized by the SEC to do business evaluations.

Hire an attorney to work with you, or at least hire a private investigator to perform background and legal dispute reviews of the company and its principals. There are also broker-dealers out there who perform due diligence on select EB-5 projects. They may well have already checked your project out.
