What would happen with my EB-5 application after June 30 if the regional center program is not extended?

Suppose I apply for EB-5 under the regional center program. What would happen to my application and investment funds after June 30 if the EB-5 regional center program is not extended? Would I get my investment back?

If the green card program is not extended, this will only affect future applicants, not persons who have already filed.

You would have to check your project documents. They may have considered that as part of the risks of investment. In the past, when the program authorization lapsed, the Visa Bulletin marked EB-5 as "unauthorized" and would not issue green cards. It seemed that the IPO shut down as well during that period.

If the program is not extended for some reason, you would have to check your subscription agreement contract to see what the terms of repayment are. However, while Grassley is threatening this, it seems highly unlikely that Congress would do this to the thousands of investors who made huge commitments.

No one is sure. But the odds are good the program will be extended.

I am almost sure it will be extended but even if it is not, as long as you filed before June 30,2021, it will not impact your application if it is later terminated. You are grandfathered in.
