What will happen with my EB-5 application now when Mayorkas ratified the 2019 EB-5 modernization regulations?

I am getting ready to file my EB-5 application for me and my family. What does Mayorka”s action mean for us? Do I have to pay the $900,000 amount? What if the other lawsuit wins and the investment amount goes back to $500,000 after I invest? Do I get a refund?

These issues are being worked out but whether you get a refund or not depends on the project and the terms of the subscription agreement.

I think the lawsuit has a good chance of winning, so I would advise holding off filing for an EB-5 until we see what the federal judge is going to do. If my friends win that case, probably the government will not appeal the decision. The new DHS Secretary likes the EB-5 program exactly as it is now.
