How does the mandamus action of EB-5 investors in the same project affect my case?

I invested in an EB-5 regional center and applied to remove my conditional green card I-829 more than three years ago. Two investors in the same project were approved after taking mandamus action. Will that help me and other investors in terms of timing, or should I do mandamus action like them myself?

Mandamus actions only help the specific individuals names in the lawsuit.

It is possible USCIS may begin to approve more I-829s for the same project - filing a mandamus action will likely expedite the process, however.

In a perfect world, USCIS officers will share information on which projects received approval and approve everyone else in that group quickly. However, this is not the case, especially when most of them seem to be working from home and in their own silos. Perhaps your attorney could put in an inquiry on your case and notify them there were two approvals in the same project. The most assured way to move your case would be to file a mandamus yourself.

You would need to look at the terms of the Judgment in their favor to decide.

It may or may not help you. USCIS process is a mystery to all who deal with USCIS on a daily basis (and I am probably being generous calling it a process).
