How do I as an EB-5 investor fill out the re-entry permit application if I have no domicile in the U.S.?

I am a conditional green card holder through the EB-5 program. I would like to apply for a re-entry permit, but I have not yet been able to establish a domicile in United States. Am I allowed to enter a friend’s or relative’s address in the Physical Address section and should I put their names for “In the Care of”? Do I have another alternative?

As a U.S. lawful permanent resident, conditional or not, you are required to maintain your immigrant intent. You should have the intention to return to the United States, which is your permanent residence, after temporary trips/visits abroad. If your residence address is with a friend or a relative in the United States, then you should use that address for purposes of a reentry permit application.

There is no other alternative since you must convince the USCIS that you truly intend to make the U.S. your home and have not abandoned the green card.

In order to maintain permanent residence, it is best to have a home here. If there is a good reason why not, you may be able to use a care of address.

if you are out of the U.S., you cannot apply for the reentry permit, you must be residing in the U.S. Once you file the application, you must await for the fingerprints which can take up 60-90 days at this time, otherwise the application may not be approved. If you are in the U.S. you may be able to use an address of your relative but you must show, ultimately, that you do use the address as a permanent address, you must demonstrate ties to the U.S. and the fact you are living here; otherwise, an officer at the port of entry can challenge your right to your green card.
