Do USCIS EB-5 processing times for I-485 represent the number of months it takes to adjudicate once the priority date of an applicant is current or is it the number of months it takes to adjudicate once the I-485 application is filed?

An EB-5 investor can file an I-485 application with U.S. CIS when there is an available immigrant visa number based on the priority date. If the EB-5 investor does not have an available immigrant visa number, then this EB-5 investor cannot file the I-485 application with U.S. CIS.

It is the number of months to adjudicate but the Priority Date in the Final Action Date chart must also be current per the Visa Bulletin.

Has the I-526 been approved? If no, then do not worry about I-485 processing until after the approval of I-526. If the I-526 has been approved, and the priority date is current, the processing time is generally calculated from the date of filing.
