How can EB-5 investors file marriage-based green card application for spouses?

I obtained my 2-year conditional green card through the EB-5 program. My partner and I have been married for more than 2 years. Can I file a marriage-based green card application for my spouse? Will she get a 2-year conditional green card or a green card that is good for 10 years?

If you have been married for over two years, she could get a ten year card but it appears they may want to limit it. We see inconsistent results when it is a conditional green card sponsor.

You may sponsor and file for a green card for your spouse assuming the category is current when you file. Since you have been married for over 2 years, your spouse should get a 10-year green card if approved.

You can file a permanent residence case to sponsor your foreign national spouse. If the I-485 of your wife is approved, then she will become an unconditional permanent resident.

Yes, you can file this if the FB-2a category is current in the month you file. Your wife would get a 10-year green card.

You need to sponsor your spouse.
