What should I do as an EB-5 investor if my spouse did not receive an official I-829 notice of receipt?

The EB-5 investor (petitioner) has filed I-829 and received the official notice of receipt, but the spouse (beneficiary) has not. The spouse only received a courtesy copy for the notice of receipt. Is the courtesy copy OK to be used for employment and travel? Should the spouse contact the USCIS and ask them to re-send an official notice?

It is advisable to contact USCIS and ask them to reissue the original.

If her name is on it that should suffice; if you have any questions call the USCIS contact center.

Receipt notices are a huge mess right now. Making an inquiry could work in this case.

Your spouse needs a stamp in their passport showing that the I-829 is pending and extending her green card then she or he can travel.

Have you thought of asking your own lawyer this question?

The courtesy copy is not valid for work and travel authorization. You can email the IPO and request that they send the official receipt or you can try to call USCIS Contact Center to schedule an infopass appointment to get a passport stamp, which is also valid for employment and travel purposes.
