What happens if an EB-5 investor who entered the US on a B visa submits I-485 within the 90 days?

I am an EB-5 investor and the priority date is already on Dates for Filing. I entered the United States with a B visa on October 15 of this year. If Date for Filing does not open in January 2024, can I submit I-485 on December 16? If I do not submit it for more than 90 days, will my I-485 be rejected in the future for this reason?

It should be ok provided you can show a change in intent after entering the U.S.
