USCIS has filed an appeal notice on the ruling that threw out the $900,000 investment amount. Most likely, such a ruling won''t come until Q1 2022.

Presently, the only cases that can be filed are direct cases at $500,000 for TEA and $1m for non-TEA direct. That means creating 10 full time jobs, or for troubled businesses, saving 10 jobs. We are expecting to see the investment amount go up when the program for regional center filings reopens hopefully in October at the beginning of the immigration fiscal year. There is talk of a staggered amount with a low $500,000 for the first year and gradually increasing up to $600,000 the year after and then $700,000 the third year. Whereas direct will remain at $1m thereby reducing the delta between TEA and non-TEA that has been a sticking point.
