How does a lawsuit against my immigration attorney affect my EB-5 I-829 process?

My family and I have lived in the US since 2013 through our investment in an EB-5 project. Our attorney filed Form I-829 for removal of conditions in 2015, but we still have not received a response. In the meantime, there has been a fraud lawsuit against our lawyer. How would this affect our I-829 processing?

If you had nothing to do with the allegations and provided the project created the requisite number of jobs and the funds were deployed, your application should be visible. But this appears to be a highly complex and unusual matter.

If the I-829 supports the grant of a ten year card, I would not see a lawsuit against the attorney affecting this unless you were somehow involved in the fraud. If you have not already, you should get yourselves another I-829 attorney.

Is the fraud related to the operations of the RC/project in which you invested? I advise that you obtain copies of everything this attorney filed on your behalf - full copies of final filings. Engage an EB-5 attorney to do a file review to make sure your I-829 filing is approvable and there are no issues with the project/RC.

That is a very old 829. Unless your lawyer''s alleged fraud impacted your 829 petition, it should not adversely impact it although they might be holding onto all of his/her cases to review for impact.
