What happens to the green card of my spouse if my EB-5 I-829 gets denied, or if we get a divorce?

My I-829 is currently pending. My wife got a 10-year green card through me since we had been married for over 2 years when she got her green card petition approved. If my I-829 case gets denied, or if we get divorced, does she get to keep her green card? Or she will lose her green card as well?

If your I-829 is denied, this most likely will impact both of you in the same way, if you divorced she can apply independently to remove the conditions, and if there are grounds, she may have other options under VAWA.

If she filed as a dependent of you on the I-526 she should only have gotten a 2 year card as you did so she needs your I-829 to be approved and to be married to get a ten year card through the EB-5 program. She may have other options.
