How can I make sure USCIS denies my EB-5 I-526 petition?

My I-526 status is pending, but I found out that my EB-5 project has serious issues and I want my capital contribution back. The regional center will not return my funds at this point. Based on the agreements, if USCIS denies my case, my capital contribution would be returned. My agreement has one clause saying “No limited partner may voluntarily withdraw from the partnership or receive the return of his or her capital contribution.” Is there any way I can get in touch with USCIS and have them deny my case so that I can get my funds back? Or if I do not submit RFE response for my I-526, does that count as voluntarily withdrawing?

I am not sure USCIS will deny your case unless the decision is supported by facts, documents and the law.
