I am on an H-1B visa since Dec. 2018 but my I-797 expired in March 2023. My H-1B – PERM is approved and I am about to submit I-140. I do not have a valid I-797 but the 6-year period is not over on H-1B. I filed for an EB-5 visa in 2021 with concurrent I-485 filing. EAD got approved before H-1B expiry and has validity until the end of 2024. H-1B extension was not filed before March 2023 because of me having a valid EAD. I received the I-131 travel permit approval as well. My question is, if I travel abroad and re-enter the US this year using my approved I-131, will there be any issues in getting back to the previous H-1B? Or would there be a need to initiate a new H-1B?
