How can I change the name of my child after having submitted an EB-5 green card petition for my spouse?

I have already submitted a green card petition for my spouse, however, we wish to change the name of our child. Would this affect the visa processing of my spouse and child? Can I file any additional documents to support this?

In order to change the name of your child, you may have to make an application to the superior court.

Once you have the legal name change completed with the Court, submit a copy to the agency where your EB-5 case currently resides. If still at the I-526 stage, then hold the document and submit at the DS-260 or I-485 stage.

I would suggest you do that after the petition is approved, during the next step in the process.

You should legally change the name of your child; when it comes time to process the residence visa, you will present the name change documents.
