When should I expect to get my EB-5 funds back?

I am an EB-5 petitioner that invested in a project in Manhattan. It has already been over 5 years since I invested, but I never heard anything about the return of my funds. While doing my taxes, I got confused by the K-1 from last year. Where can I get relevant information about this? When will I get my investment back?

    You need to reach out directly to the regional center and to the project and you need to ready your subscription agreement for the answer.

    Each project has a different repayment timeline. You should reach out to the investor service team at the regional center where you invested.

    The Regional Center you invested in should tell you this. Read the project documents you signed and if not clear, retain counsel to help explain and intervene with the Regional Center for answers.

    Do you have your green card yet? And removal of condition? You can take your money back in that case anytime you choose.

    You should have a provision in your Operating Agreement for where notices are to be sent. There also may be disclosure of an auditor. You should write to both of them for your K-1 after the Regional Center is contacted. 5 years is a while. You should definitely contact skilled securities counsel in the US to evaluate what can be done, if anything.
