When can I file based on the EB-5 Chart B Priority Date?

My EB-5 I-526 application has already been approved, but my filing date is not earlier than the Priority Date for India in Chart A. However, it falls before the Priority Date for India indicated in Chart B. When would be the earliest possible time for me to file for Adjustment of Status based on the Chart B date?

Let''s hope that USCIS opens chart B for adjustment filings in October, which they traditionally, but not always, do.

You can file for adjustment of status if you are in the U.S. when USCIS confirms that you can use Chart B for employment-based filings - this is confirmed by USCIS every month and the information is available here: https://www.uscis.gov/green-card/green-card-processes-and-procedures/visa-availability-priority-dates/adjustment-of-status-filing-charts-from-the-visa-bulletin. There is likely to be more movement forward in the visa bulletin in October of 2023.
