How and when can a direct EB-5 project be sold?

Our EB-5 project is a gas station / truck stop, with the ownership structure consisting of two U.S. citizens and the EB-5 investor. Assuming that the project is able to satisfy all EB-5 requirements once operational, can this project be sold at some point? How soon can it be sold? What are the implications to the EB-5 process if it is sold after three years? If required, the holding entity can still be intact and could make another at-risk investment after the sale.

Same rules apply to RCs and directs. If BP implemented + jobs created, EB-5 rules do not prohibit a sale. If I-829 is not filed yet, redeployment rules apply. An issue of this significance, however, must be carefully discussed with your EB-5 attorney.
