How can I maintain my conditional green card as an EB-5 dependent while studying abroad?

I am a conditional EB-5 green card holder (T53 category) and have just moved to the U.S. with my family. I am 20 years old and want to continue my university studies abroad. I will be coming home (to the U.S.) for the semester breaks. Is there any way I can still keep my conditional green card? Would I be eligible to apply for the removal of conditions with the rest of my family? Or will this pose a risk?

The USCIS is usually fairly generous with allowing students to finish their studies abroad but you definitely need to apply for reentry permit and sadly they are very slow. Otherwise, be sure not to be out for more than 5 months.

You can absolutely study abroad as a conditional green card holder. If you have ties to the U.S. and plan on visiting the U.S. every few months (with no trips longer than 6 months), you do not need a reentry permit. If you plan on having absences from the U.S. that are more than 6 months in a row, I would recommend applying for a reentry permit when you are in the U.S. to be safe.

You have an involved situation. You need a consultation appointment with an immigration attorney who can evaluate the specific details of your situation and then give you appropriate legal advice.

You need to apply for a Reentry Permit while on U.S. soil.

Consult with your immigration attorney or an experienced one, about applying for a Reentry Permit.
