How can I invest in an EB-5 visa using cryptocurrency funds?

Can I use crypto earnings as my EB-5 funds? What things do I have to prove? If an investor is already in the USA, how and where can they invest in cryptocurrencies for EB-5 purposes?

Whether it is cryptocurrency or any stock investment, you need to track the source of funds from the original source of income to investment accounts and then liquidation. Any cryptocurrency you bought in cash instead of an exchange will be difficult to track the path of funds. This is no different than keeping cash in the mattress and then trying to prove that you had that money from a lawful source.

You can use crypto but need to document where you got the money to invest in crypto and also document each and every transaction.

Yes, you can. Crypto assets are treated like other tradable securities/instruments. The source of funds used to purchase the cryptocurrency will be the crux of the inquiry.

If you can show they were lawfully earned and can be converted to U.S. dollars, should be fine.

Your question appears to have two parts. 1. I am not personally aware of any EB-5 offering that is in fact cryptocurrency based, wherein one would purchase tokens for an amount used for job creation. If there are such offerings, you would certainly want the token to be asset-backed. Further, you would want the offering to be reviewed by a securities/commodities attorney, as the tokens would likely be either securities or commodities under the current state of the law in the US. 2. You can certainly use cryptocurrency as your funds to invest in a traditional EB-5 project. You will need to be prepared to show the source of your funds, e.g. how you bought the crypto, the blockchain tracing (likely through a company such as Chainalysis) and its current fiat conversion value. You will need to work with a project that has an escrow bank that works with a cryptocurrency provider or has its own apparatus to do so.
