How do I proceed if the NVC makes a mistake with my EB-5 petition?

I have an approved petition of Direct EB-5 which was sent to NVC last month, however I received an email from NVC stating pilot program expired and they will not act on my petition. Apparently they took my case as regional center by mistake. What should we do now? We tried to contact the NVC but got no response.

    You can call NVC and tell them your petition is for a direct. However, this point is moot as the RC program was reauthorized last week.

    You can present them with evidence this was a direct case. But the problem is they do not seem to be segregating them or processing them separately, so this is very frustrating because no one has been able to get them to process direct.

    Have your attorney submit a case inquiry to change the case to direct EB-5. NVC takes time to respond and generally should respond within 2-4 weeks.
