How can I include my new spouse in my EB-5 application if the principal applicant in my case was my ex?

I am a dependent in the EB-5 application of my ex-husband. We got divorced after we filed our I-829. If I get remarried, can I file an I-130 for my new husband while my I-829 is pending? If not, how can I sponsor him?

Since you are a permanent resident, you can file an I-130 for your new spouse.

You are allowed to have your condition removed as a derivative of a divorced investor. Therefore, you can sponsor a new spouse as a green card holder even while I-829 is pending by filing I-130.
