How can I transfer from E2 status to EB-5 with concurrent filing?

Can one move from E2 Status (not E2 visa, rather the E2 from a change of status in country) to EB-5 using the new concurrent filing method?

An E-2 can convert to an EB-5 either based on a direct filing or based on a regional center filing - as soon as they have the I-965 approval you can file with a regional center project.

If you are in the U.S. in valid E-2 status you can concurrently file an I-526/I-485 (AOS). You can do so if you have a pending I-526 petition filed before June 30, 2021 last year or if you are filing an I-526 direct EB-5 petition. Investors must currently wait for Regional Centers to be recertified by USCIS to make a new EB-5 I-526 filing with a Regional Center project after May 14, 2021.
